1. Introduction
1.1 Welcome to the XpatXperience platform (“Site”). We will refer to our website and other services as our “Services” and XpatXperience will be referred to individually or collectively as “XpatXperience”, “we”, “us” or “our”. Please read the following Terms of Use carefully before using the Site or any of our Services. By browsing our site you agree to our terms and conditions. The Terms are for you to be aware of your legal rights when using our services.
1.2. This document and any documents referred to herein collectively constitute the “Terms of Use.”
1.3 Our “Services” include (a) the site, (b) the services provided by the site, (c) all information, related pages, features, data, text, images, photographs, graphics, music, sounds, videos, messages. , tags, content, programming, software, application services. Any new features added to or enhancements to the Services shall also be subject to these Terms of Service. Content posted by Users using our Services will be referred to as “Your Content.” Your content includes your usernames, store names, profile pictures, listing photos, listing descriptions, reviews, comments, videos, etc.

5. Your use of our services
5.1 We grant you a limited, non-exclusive, non-transferable, revocable license to use our Services. You agree that you will not violate any laws in connection with your use of the Services. This includes any local, state, federal and international laws that may apply to you.
5.2 You are responsible for paying all fees you owe us. You are also solely responsible for collecting and/or paying any applicable taxes for any purchases or sales you make through our Services.
5.3 You agree not to attempt to obtain the source code of the Services. You agree not to interfere with, disrupt or damage our services.
5.4 Violations of this policy may result in a range of actions, including any or all of the following: removal of listing, account suspension or legal action; if it is needed.
5.5 If you believe that a User on our Site is in breach of these terms and conditions, please contact us.
6. Purchase and payment
6.1 We currently only support credit card payments. These payments are processed through third party payment channels and may vary depending on the jurisdiction in which you are located.
6.2 All sales on the platform are urgent. The seller is obliged to complete the transaction with the buyer as soon as possible, except in cases of exceptional circumstances.
7. Responsibilities of the Seller
7.1 Sellers will properly manage and ensure the availability of relevant information, such as price and service details, and will not publish inaccurate or misleading information.
7.2 Prices for services sold are determined by the Seller at its own discretion. The service price will include any additional charges such as sales tax, value added tax, tariffs, etc. Sellers will not charge Buyer any such amounts additionally or separately.
7.3 Sellers are required to provide the services described as promptly as possible, except in exceptional circumstances. If any exceptional circumstances arise, the Seller must contact the Buyer and inform him of any delays or inability to complete the transaction.
7.4 Sellers will issue additional receipts, credit card receipts or tax invoices to the Buyer upon request.
7.5 By registering as a merchant on XpatXperience, the merchant agrees to offer services to students exclusively through the Platform. Any mentoring services provided to students who initially contacted you through the Platform must continue to be provided through the Platform.
7.6 These Terms do not prohibit a merchant from offering services outside of the Platform, provided that such services are not initiated by students who initially contacted the merchant through the Platform.
8. Commission
8.1 Seller acknowledges and agrees that XpatXperience charges fees for transactions made between sellers and buyers on the Platform. This commission is an important source of income to continue operating and improving the Platform.
8.2 Seller is strictly prohibited from circumventing the Platform's commission structure by attempting to contact students outside of the Platform for services provided through the Platform. This includes, but is not limited to, providing personal contact information, directing students to interact with you directly, or accepting payments from students outside of the Platform to avoid paying applicable fees.
8.3 Violation of this fee waiver provision may result in penalties including, but not limited to, account suspension, account termination, or legal action at the discretion of XpatXperience.
8.4 If you become aware that any merchant is attempting to circumvent the commission structure, you must immediately report such activity to XpatXperience. We take such violations seriously and rely on the vigilance of our mentors to maintain the integrity of the Platform.
8.5 If a dispute arises regarding fee evasion or any other related matter, XpatXperience reserves the right to investigate and make a final decision in accordance with our dispute resolution process.
8.6 The Merchant agrees that any commissions due to XpatXperience will be deducted directly from your funds before the remaining funds are credited to the Merchant's account.
8.7 The Merchant agrees to fully cooperate with XpatXperience in the event of any investigation or dispute related to commission evasion or any other matter arising from the use of the Platform by the Merchant.
9. Disputes with us
9.1 If you are unhappy with us, please let us know and we hope we can resolve your issue. If we are unable to resolve the issue, these rules will govern any legal dispute related to our Services:
9.2 Applicable Law. The Terms of Service are governed by local XpatXperience laws. Local laws vary depending on where you register. These laws will apply no matter where in the world you live.
9.3 You agree that any dispute or claim arising out of the Terms will be resolved, if possible, by arbitration. Judgment on the arbitration award may be entered in any court having jurisdiction. Any arbitration under the Terms will be conducted on an individual basis: class arbitrations and class actions are not permitted. Any decisions made by the arbitrator will be final.
10. Changes to the Terms
10.1 We continually update and improve the Service in an effort to find ways to provide you with new and innovative features and services. Improvements and updates are also made to reflect changing technology, tastes, behavior and how people use the Internet and our Service.
10.2 We may revise the Terms of Service, but the most current version will always be available at this link.
10.3 We will endeavor, where possible and reasonable, to contact you to advise you of material changes to any of the documents referred to in these Terms of Service. We can contact you through the system or by separate email.
10.4 The current version of the Terms of Use contains the only terms that apply to our relationship with you. Older versions of the Terms of Service will no longer apply to our relationship and will be superseded in their entirety by the current version.
